Trademark Registration in Panama

The brand is the hallmark of your company. The trademark to be registered can be a sign, logo, word, image, figure, graph, as well as the wrappers, containers, colors, among others. Designs or words combined with each other.

Trademarks registered in Panama will be valid for periods of 5 or 10 years from the date of application. These periods can be renewed 12 months before the expiration date.

From the year 2021, new guidelines are issued for the online filing of a trademark registration.

 

You will need to provide the following information:

1. Name, address, and nationality of the applicant. Additionally, in the case of a legal entity, place of incorporation and registration data, if applicable.

2. Name and address of the legal representative and, when applicable, the registration reference in the Registry of Powers.

3. The designation of a domicile in the Republic of Panama for applicants domiciled abroad, for purposes of administrative or judicial notifications related to the trademark.

4. Name and/or design of the brand, as it will be used in the market.

5. The products or services for which the trademark is to be registered, in accordance with the Niza arrangement, indicating the number of the class(es);

6. The claim of a right of priority when appropriate in accordance with international conventions ratified by the Republic of Panama.

 

The requirements to register a trademark are:

1. Power of Attorney.

2. In the case of informal management, the guaranteed certificate.

3. A reproduction of the mark in two copies when it has a special spelling, shape or color, or is a figurative, mixed or three-dimensional mark with or without color, one of which must be attached and/or digitized in the application form.

4. A translation of the mark or of certain parts of the mark where appropriate.

5. A transliteration of the mark or certain parts of it where appropriate.

6. When a right of priority has been claimed, the supporting documents indicated in the Regulation, in accordance with the international conventions ratified by Panama.

7. Declaration of use or intention to use the brand.

8. Statement claiming the color or colors as distinctive characteristics of the brand and/or the three-dimensional shape when appropriate.

9. Proof of payment of fees and rights corresponding to publication, registration, and inscription.

As soon as the trademark process is completed, you can use the ® symbol to demonstrate that your trademark has complied with what is required by law and is duly registered.
